Thicket Terms of Service
Version 1.0
Effective: October 19, 2026
These Terms of Service ("Terms") are an agreement between you and Rubus Labs LLC, a Delaware limited liability company ("Rubus Labs," "we," "us," or "our"). They govern your use of Thicket, available at getthicket.com and dashboard.getthicket.com, and any related services (together, the "Service").
If you use the Service for a company, law firm, or other organization, "you" means that organization, and you confirm you have authority to accept these Terms for it. If you do not agree to these Terms, do not use the Service.
1. What Thicket Does
Thicket is a brand-protection service for small and mid-size brands and the intellectual-property attorneys who represent them. Depending on your plan, the Service may:
- Monitor daily for lookalike, typosquat, and phishing domains and websites, using sources such as DNS permutations and certificate-transparency logs.
- Automatically capture screenshots, page captures, and published domain registration records (WHOIS/RDAP) for suspect domains and websites. Thicket describes domains and websites; it does not identify, locate, or profile the people behind them.
- Use AI-assisted analysis, including through third-party AI providers, to compare suspect sites against your brand and a review rubric.
- Create timestamped record sets (hashed case records), which may include timestamped screenshots and records, SHA-256 hashes, RFC 3161 trusted timestamps, PDF reports, and time-limited public links to the record set. Trusted timestamps are obtained from third-party timestamp authorities and depend on their availability; if no authority is available, the record set will be marked as not timestamped.
- Prepare and, only after your approval, send takedown and abuse notices on behalf of the Brand Owner to registrars, hosting providers, CDNs, and blocklists (for example, Netcraft, APWG, Google Safe Browsing, and Microsoft SmartScreen). Trademark, impersonation, and phishing complaints are filed as IP and impersonation reports under each recipient's own reporting process. DMCA notices are sent only under the conditions in Section 6 (you identify a specific copyrighted work and e-sign the required statements).
Thicket monitors domains and websites. It does not monitor online marketplaces or social media.
AI-assisted analysis can be wrong. Scores and suggested actions are aids to your review, not conclusions.
2. Eligibility and Your Account
- The Service is for businesses and their professional representatives, not for personal or household use. At checkout you will be asked to confirm that you are purchasing for a business, law firm, or other organization.
- The Service is offered only to customers in the United States. We do not offer it to individuals or businesses in the EEA, UK, or Switzerland.
- You must be at least 18 and able to form a binding contract.
- You must give accurate, complete account information and keep it current.
- You are responsible for keeping your login credentials secure and for all activity under your account. Tell us promptly at [email protected] if you suspect unauthorized access.
- You may add users, including a designated approver such as your attorney. You are responsible for their actions in the Service.
3. Onboarding: Payment, Letter of Authorization, and Verification
Customer and Brand Owner. "Customer" (also "you") means the person or organization that accepts these Terms and pays for the Service, which may differ from the Brand Owner. "Brand Owner" means the owner of the trademarks, copyrights, or domains for each brand you list. You may be a law firm or agency acting for one or more Brand Owners; when you own the brand yourself, you are also the Brand Owner. Each Brand Owner must sign the LOA and complete verification before any notice is sent for its brand. You remain responsible for fees, the approvals you give, and your obligations under these Terms, including indemnity.
Setup follows this order:
- Payment. You purchase a plan through our payment processor, Stripe. At checkout you accept these Terms, the Refund Policy, and the automatic-renewal terms by checking a box before you pay.
- Letter of Authorization ("LOA"). After payment, an authorized representative of each Brand Owner separately signs (electronically or in ink) an LOA that authorizes Rubus Labs to send approved notices on its behalf for the brands, trademarks, and copyrighted works listed in it.
- Rights verification. Before any notice is sent for a brand, the Brand Owner lists each mark it relies on (registration number and jurisdiction, or the basis for unregistered rights) and each copyrighted work for any DMCA notice. We check listed registrations against the public registry record, confirming the owner name matches the Brand Owner, and notices cite only verified registrations.
- Domain verification. For self-serve brands, control of the brand's domain is verified by adding a DNS TXT record we provide. For brands added by a law firm or agency, domain verification is not required; instead, the Brand Owner's LOA must be e-signed by a signer whose identity we confirm, using an email address at the Brand Owner's own domain or another method we reasonably accept.
We will not send any notice for a brand until payment, the Brand Owner's signed LOA, and rights verification are complete, and, for self-serve brands, domain verification. Monitoring starts when payment is made. Takedown notices for a brand can be sent only after its Brand Owner has signed the LOA and completed rights verification, at which point the brand has Protected status.
Record of acceptance. When you accept these Terms, we keep a record of the version you accepted, the date and time, your account and session details, and the IP address used. We keep these records for the life of your account plus 6 years. We also email you an acknowledgment of your plan and its automatic-renewal terms.
4. Your Representations
You represent and warrant, and you will keep it true while you use the Service, that:
- You are the Brand Owner of, or are authorized to act for the Brand Owner of, each brand, trademark, copyrighted work, and domain you register with the Service.
- If you are not the Brand Owner, the Brand Owner has authorized you to act for it in connection with the Service, including to list its brands and marks, to designate approvers, and to approve notices, and you will make sure the Brand Owner signs the LOA before any notice is sent for its brand. You will tell us promptly if that authority ends.
- The information you give us, including brand, trademark, and contact information, is accurate and complete.
- The person who signs each LOA has authority to bind that Brand Owner and to authorize notices for its brands.
- Each notice you approve is, to the best of your knowledge, accurate and made in good faith. This includes, for DMCA notices, a good-faith belief that the use is not authorized by the owner, its agent, or the law.
5. Authorization and Agency for Notices
- Under the LOA and these Terms, Rubus Labs acts as the Brand Owner's limited agent to send the specific notices you approve, in the Brand Owner's name or on its behalf, to the recipients described in Section 1.
- This authority is limited to notices you (or your designated approver) have approved. It does not authorize us to file lawsuits, UDRP or URS complaints, or any other legal proceeding, or to make any statement under penalty of perjury on your or the Brand Owner's behalf.
- A Brand Owner may revoke its LOA at any time by notice to [email protected]. Revocation stops future notices for its brands. It does not withdraw notices already sent, though we can help send a withdrawal on request.
- Notices identify the Brand Owner as the rights owner, are signed "Rubus Labs, as authorized agent for [Brand Owner]", and may include the contact details authorized in the LOA and timestamped screenshots and records from the relevant case.
6. Approval and Responsibility for Approved Notices
- Every notice requires approval from you or your designated approver before it is sent. Thicket does not auto-approve notices. DMCA notices always require your approval of the specific notice.
- Any follow-up, reminder, escalation, or resend of a notice, to the same recipient or a different one, is a new notice and is sent only with approval under this Section 6. Status checks that send nothing to a third party do not need approval.
- Rubus Labs may review approved notices for completeness and delivery details before sending, and may return a notice to you for correction. This review is not legal advice and does not change your responsibility for the notices you approve.
- Alerts. Alerts are shown to you, or to your designated approver, after each scan. Rubus Labs does not screen alerts before you see them. You or your designated approver decide whether to act on each alert.
- A designated approver may be one of your own staff or an attorney who represents you. One attorney or approver may approve notices on behalf of several client accounts, as long as each client has authorized that person and each Brand Owner has signed its own LOA.
- You are responsible for reviewing each case, its record set, and the proposed notice before approving it. When you approve, you confirm that you have independently reviewed the notice and its record set, that you are authorized to act for the Brand Owner, that the facts stated are accurate to the best of your knowledge, and that you have a good-faith belief the use complained of is not authorized by the owner, its agent, or the law (including after considering fair use).
- Responsibility for approved notices. You are solely responsible for every takedown, abuse, or DMCA notice that you or your designated approver approves, including the accuracy of the rights claimed in it (such as trademark or copyright ownership or authority to act) and the facts stated in it. Approval by your designated approver is treated as approval by you. You will indemnify Rubus Labs for any claim arising from an approved notice, as set out in Section 17.
- DMCA notices. We will send a notice under 17 U.S.C. § 512 only if you identify the specific copyrighted work you own or are authorized to enforce and the material claimed to infringe it. The statements required by § 512(c)(3)(A)(v) and (vi) (your good-faith belief that the use is not authorized, that the notice is accurate, and, under penalty of perjury, that you are authorized to act for the owner) will be made by you or your designated approver, who must electronically sign them before the notice is sent. Rubus Labs transmits the notice as your agent and does not itself make those statements. Trademark, impersonation, and phishing complaints will be sent as trademark or abuse reports, not as DMCA notices.
- Maximum capture age. If the newest capture for a case is more than 72 hours old when a notice is about to be sent, Thicket re-captures the site, re-hashes the record set with a fresh trusted timestamp, and asks you or your designated approver to approve the notice again before it is sent.
- Filing target. We file within one business day of your approval, on every plan. This is a target, not a guarantee. Times may be longer, for example during high volume, holidays, or outages.
7. Acceptable Use
You agree not to:
- Use the Service against domains, sites, or content where you have no rights or authority to act.
- Use the Service to harass, threaten, intimidate, or retaliate against anyone, including competitors, critics, or registrants.
- Submit or approve notices you know, or should know, are false, misleading, or abusive.
- Use the Service to suppress lawful criticism, commentary, parody, comparative advertising, or other lawful uses.
- Break any law or third-party right, or any policy of a registrar, host, or blocklist.
- Interfere with, probe, overload, or reverse-engineer the Service, or access it except through the interfaces we provide.
- Resell or sublicense the Service without our written permission. An attorney or approver may manage and approve for several client accounts, but each client Brand must be listed, verified, and paid for as a Brand on a Thicket account.
We may refuse to send, delay, or withdraw any notice if we reasonably believe it is inaccurate, unauthorized, abusive, or legally risky, or that it violates these Terms. We may also suspend your account as described in Section 18.
8. Fees, Takedown Credits, Renewal, and Taxes
Plans. Thicket is offered in three plans. Prices are per Brand.
| Plan | Monthly | Annual (prepaid) | Domains watched | Who reviews alerts | Takedowns |
|---|---|---|---|---|---|
| Monitor | $49 per month | $490 per year | 1 Brand, 1 primary domain | You | Filed on your request. No takedown credits included (0); $200 per Successful Takedown |
| Protect | $99 per month | $990 per year | 1 Brand, up to 3 domains | You | 4 per year included (monthly plans: 1 at signup plus 1 per completed 3-month block, up to 4 per year); then $200 per Successful Takedown |
| Agency (law firms and multi-brand) | $149 per Brand per month (2–9 Brands); $139 (10–24 Brands); $129 (25+ Brands) | $1,490 / $1,390 / $1,290 per Brand per year, same bands | Minimum 2 Brands; up to 3 domains per Brand | You or your counsel | 4 per Brand per year (monthly plans: 1 per Brand at signup plus 1 per completed 3-month block, up to 4 per Brand per year); then $200 per Successful Takedown |
- Brand. "Brand" means one brand name, and its primary website, that you protect through Thicket. Product lines sold under that Brand's name and on its website are included at no extra cost. A sub-brand that has its own trademark or its own website counts as a separate Brand and is billed as an additional Brand. On Agency, each such Brand counts toward the volume bands. This definition applies to accounts that sign up on or after the effective date of these Terms; customers already on beta pricing keep their existing terms until their first renewal.
- Agency minimum. Agency requires at least 2 Brands. A single Brand uses Protect.
- Agency volume pricing is whole-account. The band is set by the total number of Brands on the account, and that band's per-Brand price applies to all of the account's Brands. Brands billed to different Customers are not combined to set a band. Whenever the Brand count changes, the account is re-banded. Band changes take effect at the start of the next billing period; Brands added mid-period are prorated at the current band.
- Pooled credits (Agency). When a single Customer is billed for several Brands on an Agency account (for example, a law firm that pays for its clients' Brands), takedown credits are pooled across those Brands. Brands billed to different Customers are never pooled or combined, even if the same attorney or approver manages them; each Customer has its own account, plan, volume band, and credits. Each Brand requires its own Brand Owner authorization and rights verification; a Brand Owner that owns several Brands may cover them in one LOA listing each Brand and mark. Credits for a Brand added partway through a subscription year are prorated for the rest of that year.
- Alert review. On every plan, you or your designated approver (such as your counsel) review alerts, decide whether to act, and approve every notice under Section 6.
Takedowns.
- Successful Takedown. A "Successful Takedown" means a notice you approved is filed and, within 30 days after it is filed, the target site or domain is suspended, removed, disabled, or no longer resolves, for any reason. A notice that does not lead to a Successful Takedown within that period uses no credit and costs nothing.
- Included takedown credits are used, and the $200 per-takedown fee is charged, only for a Successful Takedown.
- Monitor includes 0 takedown credits. On Monitor, we file a takedown notice when you request it, and you pay $200 for each Successful Takedown.
- Unused takedown credits do not roll over to the next subscription year and have no cash value. Annual Protect and Agency plans receive 4 credits per Brand at the start of each subscription year. Monthly Protect and Agency plans receive 1 credit per Brand at signup, then 1 more after each completed 3-month block of paid service, up to 4 credits per Brand per subscription year.
Payment. Subscription fees are paid in advance through Stripe. You authorize us, through Stripe, to charge your payment method on file for subscription fees and for $200 Successful Takedown fees. Before you approve a notice that would not be covered by an included credit (including every notice on Monitor), the approval screen shows that a $200 fee applies if it becomes a Successful Takedown; your approval confirms your agreement to that charge. Successful Takedown fees are billed monthly in arrears on your next invoice and charged to your payment method on file. Annual-plan customers receive a separate monthly invoice for any such fees. If accrued, unbilled fees exceed $1,000, or your account is past due, we may invoice them immediately and charge your payment method on file.
Billing intervals. You can pay monthly or annually (prepaid).
Automatic renewal. YOUR SUBSCRIPTION RENEWS AUTOMATICALLY at the end of each billing period (monthly or annual) for the same period, and we will charge your payment method on file the then-current price for your plan, until you cancel. You can cancel online at any time from the Billing page in your dashboard at https://dashboard.getthicket.com/billing, and also by emailing [email protected]. Cancellation takes effect at the end of the current billing period, and you will not be charged again. For annual plans, we will email you a reminder at least 30 days (and no more than 45 days) before each renewal, stating the renewal date, price, and how to cancel. We will give you at least 30 days' notice before any price increase takes effect at your next renewal. After checkout, we will email you an acknowledgment of these renewal terms with a link to cancel.
Refunds. Annual plans: if you ask within 14 days of your initial purchase or of any renewal charge, we will refund that charge in full, minus $200 for each Successful Takedown in that period (Protect and Agency; nothing extra is deducted on Monitor). Monthly plans: no prorated refunds, but you may get a first-month refund if you ask within 7 days of your first monthly charge and no notice has been sent. Full details are in our Refund Policy at https://getthicket.com/refund.
Taxes. Fees do not include taxes. You are responsible for any applicable sales, use, or similar taxes, other than taxes on our income.
Beta pricing. Beta pricing is available only to Brands that sign up themselves through self-serve checkout at getthicket.com or dashboard.getthicket.com on or before December 31, 2026 (11:59 PM ET). It is $900 per year for one Brand, billed annually, and includes everything in the Protect plan, including 4 takedowns per year. It is not available to law firms, agencies, or Agency-plan accounts; those accounts get Agency pricing. Customers already on beta pricing when these Terms take effect keep their current $900 terms until their first renewal, whatever channel they signed up through. Beta pricing is locked until the customer's first renewal. At that renewal, the customer moves to current pricing, with at least 30 days' notice before the new price applies.
Agency pilot. Law firms, agencies, and other Agency customers may buy a paid pilot for 2 to 5 Brands under the standard Agency terms: 30 days at $149 per Brand, including 1 takedown credit per Brand, pooled when a single Customer is billed for all pilot Brands. Additional Successful Takedowns are $200 each. Unused pilot credits expire at the end of the pilot. The pilot converts automatically to Agency monthly billing, at the Agency price stated in your order form for the account's Brand count, unless you cancel before it ends; we will email you at least 7 days before the pilot ends with the conversion date, price, and how to cancel. On conversion, each Brand receives 1 takedown credit, then 1 more for each completed 3-month block of paid Agency service, up to 4 per Brand per subscription year. The pilot fee may be refunded in full if requested within 7 days of the pilot charge and no notice has been sent; this refund right applies only to the pilot fee and not to any later charge, including the first Agency charge after conversion. If the pilot fee is refunded, the pilot ends on the refund date and does not convert. Pilot specifics are set in a separate order form.
Late or failed payment. If a payment fails, we may suspend the Service, including notice sending, until payment is made.
9. No Guarantee of Outcomes
We do not guarantee that any site will be taken down, blocked, or transferred, or that any recipient will respond. Outcomes depend on third parties, including registrars, hosts, CDNs, blocklists, and site operators, which act under their own policies and timelines. We also do not guarantee that the Service will find every lookalike domain or infringing site.
10. Not Legal Advice; Not a Law Firm
- Rubus Labs is not a law firm and does not provide legal advice. Using the Service does not create an attorney-client relationship with us.
- Templates, drafts, AI analysis, and timestamped record sets are tools, not legal opinions. Rubus Labs does not guarantee that any registrar, host, platform, court, or other tribunal will accept, rely on, or act on any record, screenshot, or notice.
- You should consult your own attorney about your rights and any enforcement action, including any cease-and-desist letter, URS, or UDRP matter.
- If your attorney uses the Service, that attorney's relationship with you is between you and the attorney.
11. Our Intellectual Property and Your License
- We and our licensors own the Service, including its software, design, templates, and documentation. These Terms do not transfer any of those rights to you.
- While your subscription is active and you comply with these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service for your internal business purposes and for enforcing the brands you are authorized to protect.
- If you send us feedback or suggestions, we may use them without obligation to you.
12. Your Data and Record Sets
- You own your data, including brand assets, trademark information, and other content you upload ("Customer Data").
- As between you and us, you own the timestamped record sets and case records created for your account. Some material in them, such as screenshots of third-party sites or published domain registration records, may be owned by third parties.
- You give us a license to host, copy, process, analyze, and transmit Customer Data and record sets as needed to provide the Service, including sending approved notices and sharing record sets with notice recipients.
- We do not use Customer Data, record sets, or case records to train AI models, and we do not permit our AI service providers (OpenAI and Anysphere, Inc. (Cursor)) to do so.
- We may use de-identified, aggregated data about Service usage and performance to operate and improve the Service.
- Our Privacy Policy at https://getthicket.com/privacy explains how we handle personal information.
- After your account ends, we keep and delete data as described in the Privacy Policy. You can request an export of your record sets before the account closes.
13. Third-Party Services
The Service relies on third parties, such as hosting, AI, email, payment, and trusted timestamp providers, and it sends notices to third parties such as registrars, hosts, and blocklists. We are not responsible for third-party services, their availability, or their decisions. Your use of some third-party services, such as Stripe, may also be subject to their own terms.
14. Confidentiality
- Each party will keep the other's non-public business information that it receives through the Service confidential, use it only to perform under these Terms, and protect it with reasonable care.
- This does not apply to information that is public, already known to the recipient, independently developed, or lawfully received from someone else.
- A party may disclose confidential information if required by law, after giving notice where legally allowed.
- Notices you approve will be shared with their recipients, along with the record sets and authorized details they contain. Those disclosures are not a breach of confidentiality. Recipients, such as blocklists, may share or publish information from notices under their own policies.
15. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT AI ANALYSIS WILL BE ACCURATE, OR THAT MONITORING WILL DETECT EVERY THREAT.
16. Limitation of Liability
(a) EXCEPT FOR EXCLUDED CLAIMS, NEITHER PARTY WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, GOODWILL, OR DATA, EVEN IF ADVISED OF THEIR POSSIBILITY.
(b) RUBUS LABS' TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (i) THE FEES YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (ii) US $100.
(c) "EXCLUDED CLAIMS" MEANS (i) YOUR OBLIGATIONS UNDER SECTION 17 (INDEMNIFICATION); (ii) YOUR BREACH OF SECTION 4 OR SECTION 7; (iii) YOUR PAYMENT OBLIGATIONS; (iv) A PARTY'S BREACH OF SECTION 14 (CONFIDENTIALITY); AND (v) A PARTY'S GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR FRAUD. THE LIMITS IN THIS SECTION DO NOT APPLY TO EXCLUDED CLAIMS.
17. Indemnification
You will defend, indemnify, and hold harmless Rubus Labs and its members, managers, employees, and contractors from any third-party claims, losses, damages, and costs (including reasonable attorneys' fees) arising from:
- Any notice that you or your designated approver approved, including any claim that the notice was unauthorized or inaccurate, or that the rights claimed in it did not exist or were overstated, and any claim of misrepresentation under 17 U.S.C. § 512(f) or similar laws, except to the extent the claim results from Rubus Labs materially altering an approved notice or sending a notice you did not approve.
- Your Customer Data, or information you provided, being inaccurate or infringing.
- Your breach of these Terms or violation of law.
We will notify you promptly of any claim, let you control the defense (you may not settle without our consent if the settlement imposes obligations on us), and reasonably cooperate at your expense.
18. Term, Suspension, and Termination
- These Terms apply from when you first use the Service until your account ends.
- You may cancel at any time. Cancellation takes effect at the end of your current paid term unless the Refund Policy or Section 21 provides otherwise.
- We may suspend the Service, including notice sending, immediately if we reasonably believe you have breached these Terms (including Sections 4 or 7), your payment has failed, or suspension is needed to prevent harm or legal exposure.
- We may terminate for Cause. "Cause" means (a) you or your designated approver knowingly submit or approve a false, misleading, or unauthorized notice; (b) you use the Service against domains or content where you have no rights or authority; (c) non-payment not cured within 10 days after notice; or (d) any other material breach of these Terms not cured within 15 days after written notice. Termination under (a) or (b) may be immediate. If we terminate for Cause, we will not refund prepaid fees for the remainder of the term, except where required by law, as described in the Refund Policy.
- We may also stop offering the Service by giving at least 30 days' notice and refunding any prepaid fees for the unused term.
- Sections that by their nature should survive termination will survive, including Sections 4, 8 (for unpaid fees), 9, 10, 12, 14 through 17, and 19 through 22.
19. Governing Law
These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws rules. The UN Convention on Contracts for the International Sale of Goods does not apply.
20. Disputes
(a) Before filing a claim, a party must send a written description of the dispute and negotiate in good faith for 30 days; limitation periods are tolled during that time.
(b) Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state courts located in Greene County, Ohio, or the United States District Court for the Southern District of Ohio, Western Division, at Dayton, and each party consents to their personal jurisdiction and venue. Either party may bring an individual claim in small-claims court.
(c) EACH PARTY KNOWINGLY AND VOLUNTARILY WAIVES ANY RIGHT TO A JURY TRIAL.
(d) Claims may be brought only in a party's individual capacity, not as a plaintiff or class member in any class, collective, or representative proceeding. If this subsection (d) is found unenforceable, it is severed and the remainder of this Section applies.
(e) Any claim against Rubus Labs must be brought within one year after it arises.
(f) Either party may seek injunctive relief in any competent court to protect its intellectual property or confidential information.
21. Changes to These Terms
- We may update these Terms from time to time. Each version is labeled with a version number and effective date.
- We keep each prior version, and will provide a copy on request.
- We will give you at least 30 days' notice of any material change by email and in the Service before it takes effect. Changes that are not material (such as clarifications or corrections) take effect when posted.
- If you object to a material change, you may cancel by telling us before the change takes effect. If you do, the change will not apply to you, your subscription ends on the date the change would have taken effect, and we will refund the prepaid fees for the unused part of your term on a pro-rated basis.
- If you keep using the Service after a change takes effect without objecting, the updated Terms apply to you.
- Changes to Section 20 do not apply to disputes already pending.
22. General
These Terms, together with the LOA, the Privacy Policy, the Refund Policy, and any Thicket Service Agreement or other order form, are the entire agreement between us on this subject. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control.
Order of precedence. If there is a conflict, the following order applies: (1) a Thicket Service Agreement or other order form signed or accepted by both parties, but only for its order-specific commercial terms (plan, brands, price, billing interval, and term) and for any other provision of these Terms that it expressly identifies by section number as modified; (2) these Terms; (3) the Refund Policy; (4) the Letter of Authorization; (5) the Privacy Policy. The Letter of Authorization never expands Rubus Labs' authority beyond Section 5 of these Terms.
